Privacy Policy and Processing of Personal Data

 

The goal of HÕLP OÜ is to ensure that your personal data is always protected and that its processing is carried out transparently and in accordance with the applicable legislation. HÕLP OÜ takes the protection and privacy of personal data very seriously and acts as a data controller in accordance with the European Union’s General Data Protection Regulation (GDPR) and the laws of the Republic of Estonia.

  1. Collection and use of personal data

HÕLP OÜ collects and processes personal data for the purpose of providing and organising ancillary services, including:

  • renting a replacement car in case of vehicle breakdown or damage,
  • Providing accident assistance and/or 24/7 support,
  • cooperation with insurance companies, insurance brokers, vehicle importers and other partner companies,
  • ensuring customer service and quality,
  • obligations arising from the law.

The data collected may include:

  • first and last name,
  • contact details (phone, e-mail),
  • vehicle registration number and other vehicle-related data,
  • location data (e.g. the address where the assistance is provided)
  • insurance data (e.g. policy number),
  • call recordings and correspondence,
  • other data that is necessary for the provision of a specific service.

Personal data is collected either from the customer himself, cooperation partners (e.g. insurers, brokers, etc.) or from persons authorised by the data subject.

  1. Legal basis for the processing of personal data

HÕLP OÜ processes personal data on the following legal bases:

  • to perform a contract or carry out pre-contractual activities (e.g. providing assistance or managing a booking);
  • for the fulfilment of a legal obligation (e.g. billing, accounting, storage of data for a period required by law);
  • HÕLP OÜ on the basis of legitimate interest (e.g. ensuring the quality of services, resolving disputes, ensuring security);
  • with the consent of the data subject, if the data subject has given it (e.g. sending marketing messages).
  1. Transfer and disclosure of personal data

Personal data may be transferred only to the extent necessary for the provision of the service or for the fulfilment of a legal obligation.
The data may be shared with the following parties:

  • insurance companies and brokers,
  • rental companies (for arranging a replacement car),
  • repair companies,
  • cooperation partners in Estonia and abroad who help to provide assistance,
  • IT service providers who manage the information systems of HÕLP OÜ,
  • auditors and supervisory authorities in cases arising from the law.

If personal data is transferred outside the European Union or the European Economic Area, HÕLP OÜ ensures that the transfer of data takes place in accordance with EU data protection requirements (e.g. on the basis of the standard contractual clauses approved by the European Commission).

  1. Storage and security of personal data

HÕLP OÜ retains personal data only for as long as it is necessary for the fulfilment of the purposes described above or for the fulfilment of legal obligations.
Data that has expired will be deleted or anonymised in a secure manner.

In order to protect personal data, HÕLP OÜ implements appropriate technical and organisational measures, including:

  • limited access to data,
  • encrypted data communication,
  • secure storage of call recordings and logs,
  • training and guidance on data protection for employees.
  1. Rights of the data subject

You have the right to:

  • receive information about the processing of your personal data;
  • request correction, deletion or restriction of processing of your personal data;
  • object to the processing of their data;
  • withdraw your consent, where the processing is based on consent;
  • receive your data in a machine-readable format (data portability);
  • lodge a complaint with the Data Protection Inspectorate (www.aki.ee) if you find that your rights have been violated.

All inquiries and applications can be submitted in writing to dpo@holp.ee.
Applications will be processed within a reasonable time, but no later than within 30 days.

  1. Changes to the Privacy Policy

HÕLP OÜ may update this Privacy Policy in accordance with changes in legislation or needs related to the development of services.
The updated terms and conditions are always published on the website of HÕLP OÜ and they enter into force from the moment of publication.
